Providing your data for the purposes specified in paragraph 1) of art. 3 is mandatory. Such treatment is necessary for Marshbird Srl, the refusal to confer these data will make it impossible for Marshbird Srl to proceed with the processing of your personal data and, therefore, to fulfil the contract.

The personal data provided by you for the purposes as described above, may be brought to the attention of employees and/or collaborators of Marshbird srl and communicated to the following subjects:

Your personal data will be stored for the time defined by the reference standard, which you specify in accordance with art. 13. subparagraph 2 (a) GDPR:

Under articles 13, paragraph 2, letter b) and d), 15, 18, 19 is GDPR 21 the user may, at any time, exercise the rights below indicated:
  1. access to personal data: to obtain confirmation whether or not there is an ongoing processing of data relating to him and, in such cases, to access to the following information: purposes, data categories, recipients, retention period, right to lodge a complaint with the Supervisory Authority, the right to request rectification or deletion or limitation of the data processed or opposition to the treatment itself as well as the existence of an automated decision making process;
  2. request for rectification, deletion or limitation of processing concerning him; the term "limitation" shall mean the marking of stored data with the aim of limiting their processing in future;
  3. opposition to processing: to oppose, for reasons connected with his particular situation, to the processing of data for the performance of a task in the public interest or for for the pursuit of a legitimate interest;
  4. data portability: in the case of automated processing carried out on the basis of consent or in execution of a contract, to receive data concerning him in a structured format, commonly used and readable by automatic device; in particular, the data will be provided by the Data Controller in .xml format;
  5. Withdrawal of consent to processing for both direct and indirect marketing purposes, and for market research; the exercise of this right does not affect in any way the lawfulness of the treatments carried out before the revocation;

To propose a claim pursuant to art. 77 RGPD to the competent Supervisory Authority according to his habitual residence, workplace or place of violation of his rights; for Italy, the the competent Authority is the Guarantor for the protection of personal data, and can be contacted as detailed on website http://www.garanteprivacy.it.

The aforementioned rights may be exercised by sending a specific request to the Data Controller through the contact channels indicated in art. 1 of this information.
  • Requests relating to the exercise of his rights will be processed without undue delay and, in any event, within one month of the application; only in case of complexity and the number of requests that period may be extended for additional 2 (two) months and get data portability;
  • Please be informed specifically and separately, as required by art. 21 GDPR that where personal data are processed for marketing purposes the person concerned is entitled to object at any time, and if the party concerned objected to the treatment, your personal information will no longer be processed for such purposes .
  • The exercise of rights is not subject to any formal constraint and it is free.

    REASON FOR THIS NOTICE
    This page describes how we manage the site in relation to the processing of personal data of users who consult the site. This informative report is also provided pursuant to art. 13 d.lgs. n. 196/2003 (Personal Data Protection Code) to those who interact with web services accessible via Internet at the following address: http://www.marshbird.com
    This information is provided for the aforementioned website and not for other websites accessed by links.
    The information is also based on the Recommendation n. 2/2001 which the European Authorities for the personal data protection gathered in the Group established by art. 29 of Directive n. 95/46/EC, adopted on May 17, 2001 to identify some minimum requirements for collecting personal data on-line, and, in particular, the manner, timing and nature of the information that data controllers must supply to users when they access to web pages, regardless of the purpose of the access. The information is also subject to the provision of the Data Protection Authority n. 229 of 05/28/2014 ("finding out simplified arrangements to inform and acquire the consent for the use of cookies").

    LOCATION OF DATA PROCESSING
    The processing operations connected to the web services of this website take place at the Company's headquarters, Prato (PO) Via Franco Vannetti Donnini n. 30/32 and are only handled by technical personnel of the Department in charge of processing, or by persons in charge of occasional maintenance operations. No data deriving from the web service is communicated or disseminated. The personal data provided by users who request delivery of informative material and/or information (quotations, brochures, catalogues, CD-ROMs, newsletters, annual reports, etc.) are used with the sole purpose of performing the service requested and are communicated to third parties only where this is necessary for that purpose.

    TYPES OF DATA PROCESSED
    Browsing data
    The computer systems and software procedures used for the functioning of this website acquire, during their normal operation, some personal data whose transmission is implicit in the communication Internet protocols. This information is not collected to be associated to identified individuals, but by their very nature, might lead, through processing and association with data held by third parties, to identify the user.  This category of data includes IP addresses or domain names of computers used by users who connect to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user's operating system and computer environment. These data is used only to obtain anonymous statistical information on site usage and to check its correct functioning and is deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site; except for this possibility, the data on web contacts is not retained for more than seven days.
    Data provided voluntarily by the user
    The optional, explicit and voluntary sending of e-mail to the adresses listed on this site, or filling out the information request form, involves the subsequent acquisition of the sender e-mail adress, necessary to respond to requests, and any other personal data included in the message. Specific summary information will be progressively reported or displayed on Web pages dedicated to particular services on request.

    COOKIES
    No personal user data is acquired by the site. We do not use cookies to transmit personal information, nor are used “persistent cookies” of any kind, or systems for tracing users or profiling cookies. The use of “session cookies” (which are not stored permanently on the user's computer and disappear when the browser is closed) or other technical cookies is strictly limited to transmitting session identifiers (consisting of random numbers generated by the server) necessary to allow safe and efficient exploration of the site. The session cookies used in this site avoid using other techniques potentially prejudicial for the confidentiality of navigation and do not allow the acquisition of personal identification data. We provide for more complete descriptions of the two main categories of cookies, reiterating that this site uses exclusively technical cookies.

    1. Technical Cookies.
    Cookies are used solely for the purpose of "making the transmission of a communication in an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the Subscriber or user to provide such service "(see article 122, paragraph 1 of the Code).
    They are not used for other purposes and are normally installed by the owner or operator of the website. They can be divided into navigation or session cookies that guarantee normal browsing and using of the website (allowing, for example, to make a purchase or log in to access restricted areas);  analytics cookies, treated as technical cookies, which are used directly by the site operator to collect information, in aggregate form, about the number of users and how they visit the same site; functionality cookies, which allow the user browsing according to selected criteria (e.g., language, products selected for purchase) in order to improve the service for him. For the installation of these cookies is not required the prior consent of the users, while it is understood the obligation to provide this information in accordance with art. 13 of the Code.

    1. Profiling Cookies.
    Profiling cookies are intended to create user profiles and are used in order to send advertising messages in line with the preferences expressed by the same while browsing the net. Because of the particular invasive nature that such devices may have within the private sphere of the users, the European and Italian legislation provides that the user should be adequately informed about their use and need to express its valid consent. They are mentioned in art. 122 of the Code which state: "the storage of information in the terminal device of a contractor or a user or the access to information already filed is permitted only on condition that the contractor or the user has given his consent after being informed with the simplified procedures referred to in Article 13, paragraph 3 "(Article 122, paragraph 1, of the Code). This site does not use cookies in any way referring to art. 122 of the Code whereby "the storage of information in the terminal device of a contractor or a user or access to information already filed is permitted only on condition that the contractor or the user has given his consent after being informed with the simplified procedures referred to Article 13, paragraph 3" (Article 122, paragraph 1, of the Code).

    OPTIONALITY OF DATA SUPPLY
    Apart from what is specified for navigation data, the user is free to provide personal data contained in the request forms or anyway indicated in contacts to request the sending of information, informative material or other communications. Failure to provide such data may make it impossible to obtain what has been requested. For completeness it should be noted that in some cases (not subject to the ordinary management of this site) the Authority can request news and information pursuant to Article 157 of Legislative Decree no. 196/2003, for the purpose of monitoring the processing of personal data. In these cases the answer is mandatory under penalty of administrative sanction.

    METHOD OF TREATMENT
    Personal data are processed with automated tools for the time strictly necessary to achieve the purposes for which they were collected. Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access.

    RIGHTS OF INTERESTED PARTIES
    The subjects to whom the personal data refer have the right at any time to obtain confirmation of the existence of the data and to know its content and origin, verify its accuracy or request its integration or updating or rectification (article 7 of the d.lgs. n. 196/2003). Pursuant to the same article, users have the right to request cancellation, transformation into anonymous form or blocking of data handled in violation of the law, and to oppose, in any case, for legitimate reasons, to their treatment.
